These terms govern your use of Sotto — a private marketplace for the considered exchange of mechanical timepieces. By creating an account or accessing the platform, you agree to be bound by these terms in their entirety.
These Terms of Service ("Terms") constitute a binding legal agreement between you and Sotto Technologies Ltd. ("Sotto", "we", "us"). By registering, browsing, or transacting on sottoo.app, you accept these Terms without reservation.
We may revise these Terms at any time. Material changes will be communicated by email to the address on your account at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the revised Terms.
You must be at least 18 years of age to use Sotto. By creating an account, you represent and warrant that you meet this requirement.
All users must complete identity verification (KYC) via our regulated third-party provider, Sumsub, before transacting. Verification is conducted under applicable Anti-Money Laundering (AML) and Counter-Terrorist Financing (CTF) frameworks in Turkey, the European Union, and the UAE.
Users who are subject to sanctions, or who are acting on behalf of a sanctioned entity, are prohibited from using the platform. Sotto reserves the right to terminate accounts upon identification of such activity without prior notice.
Each verified user is assigned a stable, opaque identifier ("n° ID"). This ID is used in all communications between counterparties. Your real identity is never disclosed to another user on the platform.
Sotto retains your verified identity for compliance purposes and may disclose it to competent authorities when required by applicable law. Your identity is processed and stored in accordance with our Privacy Policy.
You may not attempt to identify, deanonymise, or contact another user outside of the Sotto platform. Any such attempt constitutes a material breach of these Terms and will result in immediate account suspension.
Sellers warrant that all listed items are genuine, accurately described, and legally owned or consigned. Misrepresentation of condition, provenance, or documentation constitutes fraud and will be referred to the relevant authorities.
Listings must include a minimum of ten photographs meeting Sotto's studio specifications, accurate dial and case references, movement calibre, service history where available, and proof of original purchase or provenance chain.
Sotto reserves the right to remove any listing that does not meet platform standards, or where authentication cannot be confirmed. No compensation is owed for a listing removed for cause.
Auction bids on Sotto are sealed. No bidder can see the amount or identity of another bidder during an active auction. All bids are final and binding once submitted.
Sellers may set a confidential reserve price. If the highest bid at auction close does not meet the reserve, the auction ends without a sale. No fees are charged in this case. Sotto does not disclose reserve amounts to prospective buyers.
In the event of a technical error affecting bid transmission or auction timing,Sotto reserves the right to extend, cancel, or re-run the affected auction. Decisions made in good faith under such circumstances are final.
Upon acceptance of a sale, the buyer's funds are held in escrow by Sotto until the item has been physically received and authenticated by our appointed independent partner. Funds are not accessible to the seller until authentication is confirmed.
If authentication fails, both parties are notified immediately. The item is returned to the seller at Sotto's cost, and the buyer's funds are released in full within 5 business days. No transaction fee is charged on a failed authentication.
Escrow accounts are held with regulated financial institutions. Sotto does not earn interest on escrowed funds. A detailed breakdown of escrow mechanics is available on request from Sotto Concierge.
Transaction fees are deducted at settlement. Current rates are published on the Pricing page and are incorporated into these Terms by reference. Sottoreserves the right to revise fee structures with 30 days' notice to existing members.
Payments are processed via Stripe Connect (EU and UAE transactions) and Iyzico (Turkey). Both processors operate under PCI-DSS Level 1 compliance. Sotto does not store payment card data directly.
Membership subscriptions are billed monthly or annually. Subscriptions are non-refundable once the billing cycle has commenced, except where required by applicable consumer protection law.
Sotto operates on a tiered membership model. All tiers require completed KYC. Features available at each tier are described on the Pricing page. Sotto may introduce new tiers or modify existing tiers with reasonable notice.
Membership is personal and non-transferable. Account sharing is prohibited. Multiple accounts created by the same natural person are not permitted and will result in all associated accounts being suspended pending review.
The following are strictly prohibited on the platform:
All disputes are reviewed by a Sotto concierge — a qualified human reviewer, not an automated system. Either party to a transaction may open a dispute within 48 hours of delivery confirmation.
Sotto's decision in a dispute is final within the platform. For matters not resolved to a party's satisfaction, applicable consumer protection and arbitration frameworks under the governing law apply.
You may close your account at any time via account settings. Active escrow positions must be settled before closure is complete. Sotto retains records as required by applicable AML regulations for a minimum of 5 years post-closure.
Sotto may suspend or terminate accounts for breach of these Terms, failure to maintain KYC requirements, or regulatory necessity, with or without notice depending on the severity of the cause.
These Terms are governed by the laws of the Republic of Turkey for users accessing the platform from Turkey. For users in the European Economic Area, EU consumer protection law applies where mandatory. For UAE-based users, applicable UAE Federal Law governs.
Nothing in these Terms limits rights you may have under mandatory consumer protection laws in your jurisdiction.
